There isn't any law that says a company have to recall workers who are laid off from their job. It's nice for them to do so, but it is not a requirement. As long as the layoff was legitimate, or perchance the duties of the position have changed (less responsibility, actual duties have changed) that would warrant them to recompense the job less money.
If you are contained by an "at-will" state then an employer can let you be in motion with or without see.

Unfortunately legal. If they had packed your positions with younger personnel and the majority of those laid off be 40 and older then you would unquestionably have grounds to pursue legal goings-on under the ADEA (supreme court just ruled on this exact type of covering today. 33 laid off and 40 and older. All replaced near younger staff.) Or if only minorities were let go and replaced with another specific race. If this is not your situation I am afraid you are out of a work and no legal recourse. I'm so sorry. Horrible especially in todays cutback. Of course it's legal. Companies can do whatever they channel. Just because you're laid off, doesn't mean they're going to phone call you back (unless they make arrangements at the time of the lay-off).

unfortunately yes they can unless it is specified by the company contract. you can ask the labor department to inquire about it and your employer will hold to answer
