If you grasp hurt on a position and you return to work on bedside light duty what percentage of your repay do you seize.?

I work at mclanes in nicholasville ky. I got hurt while working and my human resources department said even though I am at work and working underneath restrictions I am only elliagable for 66% of my pay. I simply wanted to know why it is the same as if you are at home recovering or if you certainly have to suffer and work. My past advocate said she would have to check into it but she is almost positive that if you are at work on any restrictions then you should draw from all you hourly amount. I know that my work place has be very sneaky before so I freshly wanted to check into this myself. Please give me a response soon. I appreciate it intensely much.

Depending on the restrictions and job classification your placed surrounded by, you could be eligible for making as little as minimum wage. Again this depends on your state regulations and what restrictions you are put on. While your out on Workers Compensation, they take care of lost wages. When you run back to work on light duty, your still on Workers Compensation. However, with the sole purpose a certain percentage gets remunerated from Workers comp. If your collecting a pay check from the employer, but it is for a different job classification or restrictions consequently the Workers comp claim will process for any lost wages during that time.

It's not sneaky at all, its the employer right to do that. Think about it, you won't be doing the same duties you be doing before you got hurt. You wont be doing like activities you were doing back you got hurt. So you won't get like pay when you go pay for unless your released to work without restrictions.

But again your claim will be processed and you will be compensated for any time lost or wages lost while out on wc leave.

you are allowed your full pay. work for a workers comp attorney in monterey. The company have to pay you your regular wage. having restrictions at work does not issue your pay it only have to limit your ability to execute your regular job. it is up to them to provide for you these accomodations. talk to your attorney about it.

Once your lawyer checks for you, You will find out that yes you should get your full pay packet. I have never heard of a company anyone so petty. Good Luck
